Welcome to use the character customization services provided by XMANART (hereinafter referred to as "we", "the Studio"). Please carefully read the following Terms of Service. Using our services indicates that you agree to comply with these terms.

1. Service Overview

1.1 Service Content

We provide AI-technology-based character customization services, including but not limited to:

• Female character customization
• Professional character design
• Male character customization

1.2 Service Features

• AI-driven creation: Carry out character design and creation based on advanced AI technology, ensuring the authenticity and similarity of the character image, and the professionalism and uniqueness of the works
• Personalized customization: Customize an exclusive character image according to the reference photos and detailed requirement description you provide
• Diversified styles: Support multiple artistic styles, including realistic, cartoon, anime, illustration and other forms of expression
• High-precision restoration: Through multi-angle reference photos, ensure that the character image is highly matched with your expectations
• Professional quality assurance: Each work will be carefully produced and optimized multiple times to ensure it reaches a high-quality standard
• Flexible modification service: Provide multiple modification opportunities to ensure the final work can to the greatest extent meet your needs
• Fast delivery: Standard service completed within 48–96 hours, professional customization handled with priority
• Safe and reliable: Strictly protect your privacy and the copyright of the works to ensure information security

2. User Responsibilities and Obligations

2.1 Provision of Materials

The user needs to provide:

• Clear photos of the person (front, side, etc.)
• Style reference images
• Detailed requirement description
• Valid contact information (optional)

2.2 Content Compliance

The user undertakes that all materials and requirements provided:

• Do not violate laws and regulations
• Do not infringe others’ intellectual property rights
• Do not contain pornography, violence, hate and other improper content
• Do not involve politically sensitive content

2.3 Portrait Right Confirmation

The user confirms:

• Has the lawful right to use the provided photos
• If another person’s portrait is involved, the relevant authorization has been obtained
• Bears full responsibility for issues arising from portrait right problems

3. Service Process and Delivery

3.1 Order Processing

• Standard service: Estimated completion within 48–96 hours
• Professional customization: Prioritized over standard services

3.2 Delivery of Works

• Final works are delivered via email or the order query page
• Original version files are provided

3.3 After-sales Policy

• Standard service: one modification, small-scope modification
• Professional customization: provide 3 modification opportunities
• Modification requests should be put forward within 7 days after receiving the works; after 7 days, modification services will no longer be provided

4. Payment and Refunds

4.1 Payment Methods

• Payment methods are as displayed on the page, primarily provided by third-party providers
• Production begins upon successful payment
• Prices apply as displayed on the website

4.2 Refund Policy

Refund can be applied for in the following circumstances:

• In the case that production has not yet started
• The information provided by the user is inaccurate/incomplete/leads to inability to produce
• The finally completed works seriously do not conform to the information provided by the user
• We breach our service commitments
• Technical problems occur during production leading to inability to produce

No refunds will be provided in the following situations:

• Dissatisfaction with the style of the works caused by personal aesthetic preferences (the style of the works is produced based on the reference images provided by the individual)
• Overly precise and stringent requirements (for example: requiring the works to be exactly the same as the reference images, or requiring the degree of overlap between the works and the description to reach more than 90%)
• Misunderstandings caused by unclear requirement descriptions
• Orders that have started production and orders that have been completed
• Images or requirement content uploaded and submitted by the user involve pornography, violence, hate, politically sensitive and other improper content; will not be produced, and no refund will be given
• Other force majeure factors leading to inability to produce

5. Intellectual Property

5.1 Copyright in Works

• Upon delivery, you obtain the right to use the work
• You may use the work for personal use, social media, and commercial purposes
• We retain the right of attribution and the right to display the work. If used for display, we will confirm with you and obtain your consent

5.2 Use Restrictions

You shall not:

• Use the works for any illegal or non-compliant purposes, including but not limited to pornography, violence, hate, politically sensitive and other content
• Without obtaining another person’s portrait authorization, use the works for commercial use or other uses
• Use the works for malicious dissemination or defamation

6. Disclaimer

6.1 Technical Limitations

• AI creation is inherently uncertain; results may differ from expectations
• We do not guarantee absolute accuracy or perfection of the works
• Technical failures may cause service interruptions

6.2 Limitation of Liability

• Our liability is limited to refunding the service fees
• We do not bear indirect losses or compensation for mental damage
• We are not responsible for the consequences arising from the user's use of the works

7. Privacy Protection

• We strictly protect the personal information and photos you provide
• Will not disclose user information to third parties with whom we do not have a cooperation relationship

8. Service Changes and Termination

8.1 Service Changes

• We may adjust service content and pricing
• Material changes will be communicated to users in advance
• Paid orders will be fulfilled under the original terms

8.2 Service Termination

Under the following circumstances we may terminate the service:

• The user violates the Terms of Service
• The user provides false information
• Technical or legal reasons make it impossible to continue to provide the service

• Disputes should first be resolved through amicable negotiation
